ELIGIBILITY: The BLACK FRIDAY GHOST® $1,000 GIFT CARD SWEEPSTAKES (the "Sweepstakes") is open to legal residents of the store’s region the entries are entered in who are eighteen (18) years of age or older at the time of entry. Officers, directors, and employees of GHOST, LLC ("Sponsor"), their affiliates, subsidiaries, advertising and promotion agencies (collectively, "Promotion Parties"), and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or persons living in the same household, whether or not related, are not eligible to enter the Sweepstakes or win a prize. The Sweepstakes is void where prohibited by law.
SWEEPSTAKES PERIOD: The entry period begins at 1:00 AM Eastern Time ("ET") on Friday November 29, 2024, and ends at 12:59 AM ET on Tuesday December 3, 2024 (the "Sweepstakes Period").
HOW TO ENTER: You must enter using our mobile application, which can only be accessed via mobile device. You must have an account with GHOST® to enter.
a) Download the latest Version 3.6 of the GHOST® App (the "App") from either the Apple App Store or the Google Play Store and sign in or create a GHOST® account.
b) Once logged in, tap "Enter the BLACK FRIDAY GHOST® $1,000 GIFT CARD Raffle Sweepstakes" to receive one (1) entry.
c) Additional entries can be earned by redeeming GHOST® Loyalty Points through the App. Each additional entry requires redeeming 100 GHOST® Loyalty points per entry.
Limit: One (1) automatic entry per person for the duration of the Sweepstakes. Additional entries limited by the total number of GHOST® Loyalty Points in a user's balance during the Sweepstakes Period. For example, if a user has 500 points, they are limited to five (5) additional entries throughout the Sweepstakes Period.
Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries, which will be disqualified. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You may not use multiple email addresses, identities, or devices in an attempt to obtain additional entries or otherwise circumvent the rules. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name identified on your GHOST® account.
Alternative Method of Entry/Obtaining Additional Entries: To enter without creating a GHOST® account, or to obtain additional entries without redeeming reward points, please hand-print your full name, complete mailing address, phone number (with area code), date of birth, email address, and the name of the Sweepstakes you wish to enter on a 3x5” card or piece of paper and mail it to: BLACK FRIDAY GHOST® $1,000 GIFT CARD “RAFFLE” SWEEPSTAKES Entry, GHOST, LLC, 400 N STATE ST, Suite 420, Chicago IL 60654. You will receive one (1) entry into the Sweepstakes for each fully completed card or piece of paper that we receive before the end of the Sweepstakes Period.
RANDOM DRAWING/WINNER SELECTION: On or about December 4, 2024, three (3) potential winners will be selected in a random drawing from all eligible entries received during the Sweepstakes Period. The drawing will be conducted by Sponsor, whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning depend on the number of eligible entries received.
WINNER NOTIFICATION: Sponsor will attempt to notify the potential winner by email within three (3) business days of the drawing date, using the then-current email address associated with their GHOST® Account or the email provided on their mailed card or piece of paper. Sponsor shall have no liability for incomplete, late, or incorrect entries, or for any winner notification that is lost, intercepted, or not received by a potential winner for any reason. Potential winners must sign and return Sponsor’s Affidavit of Eligibility and Release (“Affidavit”) in order to receive the prize. If a potential winner does not respond and return the Affidavit within five (5) business days after the notice is sent, the potential winner forfeits their prize, and Sponsor will select alternate potential winners in his/her place at random from the remaining eligible entries received.
PRIZE: Three (3) winners will be awarded One (1) GHOST® $1,000 GIFT CARD. Approximate Retail Value ("ARV"): $1,000. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value. Winner is responsible for all taxes and fees associated with prize receipt and/or use.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge, and hold harmless Sponsor and the Promotion Parties from any and all injuries, liability, losses, and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant's participation in the Sweepstakes or acceptance, possession, use, or misuse of any prize; and (c) to the use of his/her name, voice, performance, photograph/video, image and/or likeness for programming, advertising, publicity, and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, Sponsor may select winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor.
LIMITATIONS OF LIABILITY: The Promotion Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded.
DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Nevada; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Nevada without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Nevada.
